Constitution of No
If President Obama's motto is "Yes, we can," the Constitution's is "No, you can't."
By U.S. Senator Jim DeMint
When a reporter asked House speaker Nancy Pelosi (D., Calif.) during a press conference last year where the Constitution granted Congress the authority to enact an individual health-insurance mandate, she answered, "Are you serious? Are you serious?" Speaker Pelosi then dismissed the question and moved on to the next reporter.
This exchange illustrates the way "yes we can" liberals treat the Constitution: They simply ignore it when it gets in the...

The Senate voted 83-7 tonight to prohibit funds in the FY2010 Transportation-HUD Appropriations bill from going to ACORN.
Even after some really bad ACORN publicity, there are still 7 liberals in the Senate who want to shovel taxpayer funds to this criminal organization. Here are the ACORN-7:
Dick Durbin (D-IL)
Roland Burris (D-IL)
Robert Casey (D-PA)
Kirsten Gillibrand (D-NY)
Patrick Leahy (D-VT)
Bernie Sanders (I-VT)
Sheldon Whitehouse (D-RI)
Getting 83 votes against ACORN is a major accomplishment for conservatives and its the result of persistence. Two efforts earlier this year were not so successful.
Sen. David Vitter (R-LA) offered...

Nancy Pelosi may hold a vote this week to disapprove of Joe Wilson's outburst if he does not apologize again on the House floor.
This is what Sen. DeMint had to say about this question over the weekend.
Rep. Joe Wilson's home-state senator says he doesn't expect the South Carolina congressman to apologize on the House floor, as House Democrats are demanding.
"I don't think he's going to do any more apologizing," Sen. Jim DeMint (R-S.C.) said in an interview at the Taxpayer March on Washington. "They just don't want to...

Millions of American children aren't the only ones going back to school this week. The Senate returns tomorrow from its August break where Senators were pummeled by constituents demanding that they say "no" to more government.
At 5:30 p.m. on their first day back in class, Senators will be given a test to see if they learned anything from the people who elected them.
Lucky for the politicians, they already know the question on their first pop quiz. It's simple. Should Congress create a new government tourism advertising agency to provide...

The President's speech last night was not a speech given by someone whose strategy is to win Republican support for his health care reforms. It had a few token lines giving lip service to alternative reforms, but the overall tone of the speech was very partisan and the substance was wildly liberal.
There's only one logical conclusion we can draw from this. The President has decided to force Congress to pass the most extreme bill possible. Yet he knows that Democrats in his own party are the biggest obstacle to...

Marco Rubio's campaign released this new web ad yesterday that highlights the differences he has with his opponent on economic policy. With unemployment over 10% in Florida, it's time for some pro-growth leadership in the state.

One of President Obama's early attempts to deflect attention away from his unpopular health care policy was to attack Sen. Jim DeMint (R-SC) for saying the debate would be Obama's "Waterloo."
Of course, now everyone agrees DeMint was right. Saying this debate is make-or-break for the president now is stating the obvious.
But one thing that may be overlooked is that the health care debate is also the GOP's Waterloo. Just as the president has everything to lose, so do Republicans.
Conservative activists across the country are energized like never before in...

Here are the August employment numbers from the new jobs report out just this morning. It's not pretty.
Non-farm payroll dropped in August by 216,000 jobs.
The number of unemployed persons jumped to 14.9 million, which is the highest level in American history.
The unemployment rate is now 9.7%, which is highest level since August 1983 (26 years).
Since the beginning of the year, we've lost 3.1 million jobs and the unemployment rate has increased by 2.5 percentage points.
Since President Obama was elected in November 2008, we've lost 5.3 million jobs and the unemployment rate...

We're now learning of yet another messaging shift for the administration on health care (at least the eighth over the past month). This time Team Obama plans to move to a more confrontational tone on health care. Here's a list of eight strategy changes the administration has made since late July.
Avert a crisis: He sought to reframe his plans as a matter of improving the lives of most Americans, not just rescuing the uninsured, and to remind voters that hes trying to avert a health care crisis, not...

Here is a list of the important page numbers for several of the provisions contained in the 1,018-page health care plan written by Democrats in the House.
Page 19 - Section 102(c) prohibits the sale of private individual health insurance policies, beginning in 2013, forcing individuals to purchase coverage through the federal government
Page 30 - Section 123 establishes a new board of federal bureaucrats (the "Health Benefits Advisory Committee") to dictate the health plans that all individuals must purchase-and would likely require all Americans to subsidize and purchase plans...

Last week, Sen. Jim DeMint (R-SC) told a group of Tea Party organizers the obvious: that President Obama's rush to pass an unpopular health care takeover will hurt him politically and open the door for alternatives that actually work. Here's the quote:
If we're able to stop Obama on this, it will be his Waterloo. It will break him, and will show that we can — along with the American people — begin to push those freedom solutions that work in every area of our society.
Rather than defend the merits of his...

Last night, the Senate passed an amendment to the Defense Authorization bill that criminalizes thought. The so-called "hate crimes" legislation seeks to increase criminal penalties based on a person's motive for a crime. Sen. DeMint spoke against the amendment and explained how such a policy would undermine the American principle of "equal justice" under the law.

U.S. Sen. Tom Coburn (R-Oklahoma) has sponsored legislation giving members of Congress more procedural tools to stop unconstitutional legislation. It's just another reason to support Coburn's re-election campaign.
According to Coburn's press announcement, the Enumerated Powers Act requires the following:
1) Each Act of Congress shall contain a concise explanation of the specific constitutional authority relied upon for the enactment of each portion of that Act.
2) Failure to include such an explanation gives rise to a point of order in either House of Congress.
3) In the Senate, the point of order...

Sen. Barbara Boxer (D-CA) got a little testy at this hearing. She took issue with being called "Ma'am" by this General and insisted on being called "Senator" because she's worked so hard for the title. Hopefully, someone will make her work a little harder for it next year.

Fellow Conservatives:
I am proud to announce the third Senate Conservatives Fund endorsement for the 2010 cycle. It goes to Marco Rubio, who is running for the U.S. Senate in Florida.
At a time when Republicans across the country are looking for new leaders to champion the cause of freedom, Marco Rubio's articulate and passionate support for conservative principles is inspiring. He is quickly gaining support in Florida, and he's energizing Republicans across the country.
Unfortunately, Marco is being overlooked by some in the Republican Party at a time when his leadership is needed most. That's...

The Conservative We're Looking For

By Jim DeMint
U.S. Senator Representing South Carolina
Once there was a poor farmer who wanted to become fabulously rich in the diamond trade. He deserted his farmland and traveled the world looking for diamonds until he was too old to look anymore. He returned home penniless, only to discover that the fields around his home were thick with flawless diamonds as big as your fist.
The poor guys fortune had been right under his nose, but he had wasted his whole life looking everywhere but in his own...

Fellow Conservatives:
I am proud to announce the second Senate Conservatives Fund endorsement of the 2010 cycle. Today, we are endorsing former Congressman Pat Toomey who is running for the U.S. Senate in Pennsylvania against Senator Arlen Specter.
I had the privilege of serving with Pat in Congress when he represented Pennsylvania's 15th Congressional District. We were both elected in 1998, and for six years we worked closely together to advance economic freedom, national security, and traditional family values. Then we honored our term limit pledges and gave up our seats.
I can tell you without reservation...

A new Quinnipiac University poll has Pat Toomey trailing Arlen Specter by just 9 points, which is down from the 20 point lead he had earlier. RTTNews has the story here.
According to the poll, Specter holds a 46 - 37 percent lead over Toomey compared to the 53 - 33 percent lead he held on May 4, when the last poll was released.
"Senator Arlen Specter's numbers have slipped since the controversy that followed his switch to the Democratic Party, but he's still better off than he would have...

Sen. Chris Dodd (D-Connecticut) is in deep trouble. He took a sweetheart mortgage deal from Countrywide and also slipped a provision into the stimulus bill allowing AIG to use taxpayer bailouts for executive bonuses. He's the chairman of the Senate Banking Committee and appears to be trading favors with the industry left and right. All of this has taken a toll on his popularity back home.
Now he's trying to change the subject. He just started...

It was another Friday and the Obama Administration made another attempt to bury some bad news.
Yesterday, the Justice Department decided not to prosecute the Black Panthers who brandished weapons on election day to keep people from voting. Here are the videos in case you didn't see them.
The president's decision to protect these thugs appears to be an attempt to protect other "organizers" such as ACORN and La Raza, which have been known to use illegal practices to achieve their goals.
It is also hard not to wonder whether the president's choice for the...

We said earlier we would be happy with Arlen Specter at the top of the Democratic ticket in Pennsylvania; his base will be thin and folks are ready for new blood. We may still get our wish but Specter is going to have to win a Democratic primary first. Politico reports the news here.
Rep. Joe Sestak (D-Pa.) confirmed that hes planning on challenging Sen. Arlen Specter (D-Pa.), in an interview this afternoon with CNNs Wolf Blitzer.
We have to ask the question will [Specter] be with...

POLITICO reports this morning that Sen. Arlen Specter is working the phones to win the support of Democratic Party insiders, but many are withholding their support.
But if Allegheny County is in any way representative of the rest of the state, Specter will have his work cut out persuading rank-and-file Democrats to get behind him.Voters have to get to a comfort level with him as a Democrat that does not exist yet, [Allegheny County Democratic Committee Chairman James] Burn said. If the primary...

U.S. Sen. Arlen Specter (Democrat, then RINO, now Democrat again — Pennsylvania) was on Meet the Press this morning. Perhaps the most telling exchange was when David Gregory asked him what he got in terms of a pay-off from the Democrats.
GREGORY: I want to move on to the question of what it took for the democrats to get you. What were you offered? What inducements were you given to switch parties? SEN. SPECTER: None. GREGORY: None? You won't keep your seniority? SEN. SPECTER: I will....

Sen. Michael Bennet (D-Colorado) was appointed to the Senate after Ken Salazar left to head the Interior Department. Bennet was a big Obama supporter who got handsomely rewarded with a Senate seat. We'll review Bennet's short, yet extremely liberal record in the Senate later. The good news now is that folks are beginning to gear up to run against him. Last week, Ken Buck announced his plans to run against Bennet in 2010. We don't know much about Buck or his chances, but he appears to be saying...
